This is the Privacy Statement of Datagator B.V. (“Datagator”, “we”, “us” or “our”). Datagator is the data controller for the processing of your personal data as described in this privacy statement. Personal data is collected, secured, and otherwise processed in accordance with the General Data Protection Regulation (“GDPR”).

This Privacy Statement applies to www.joindatagator.com (“Website”) and the Datagator browser extension (“Browser Extension”).

1. Personal data we process

Datagator processes personal data in the following categories:

Browsing Data

Our Browser Extension processes information about the webpages you visit (“Browsing Data”) to determine whether you have been affected by a privacy violation. For your privacy, all Browsing Data is processed exclusively on your device.

Only Browsing Data related to websites that (might) have privacy issues is stored (locally on your device). No other Browsing Data is stored.

Browsing Data is used for: uncovering privacy violations, providing privacy insights, collecting evidence and anonymizing statistics

Evidence

When you choose to participate in a claim, we need to be able to prove that you have been affected by a privacy violation. "Evidence" is what we call the data we receive from you that we need to support your claim.

Evidence may include the following data:

  • Date on which the violation took place;
  • Cryptographic hash of the relevant Browsing Data;
  • Information about cookies, such cookie name or value, and whether or not a cookie notice was shown and which choice was made;
  • Any additional data we ask your explicit consent for.

Evidence is used for: bringing and handling cases

Account Information

We require you to create an account with us before you can use the Browser Extension. We process the following personal data, collectively referred to as “Account Information”, when you create an account with us:

  • Login information, such as email address and password;
  • Contact information, such as name, email address, and phone number;
  • Preferences, such as email preferences;
  • Internet Protocol (IP) address (not stored);
  • Event data, such as the date and time of account creation, email address verification, most recent successful login, most recent Account Data change, acceptance of our terms and conditions and acceptance of this privacy policy.

Account Information is used for: bringing and handling cases

Communication Data

We process the following personal data when we contact you, or when you contact us with a question, comment, request, or complaint ("Communication Data"):

  • Contact data, such as name and email address;
  • Message body 

Communication Data is used for: communicating with you

Visitor Traffic Data

We process the following data of individuals who browse our Website (“Visitor Traffic Data”):

  • Browser and device data (user agent), such as operating system and browser name, device manufacturer;
  • Usage data, such as pages visited, your activity on the Website, and the pages that led or referred you to our Website;
  • Geographic region, based on your IP address;
  • Internet Protocol (IP) address (not stored).

Website Traffic Data is used for: improving our Website, providing our Website

Extension Traffic Data

We process (and never store) the following  data of individuals who use our Browser Extension (“Extension Traffic Data”):

  • Browser and device data (user agent), such as operating system and browser name, device manufacturer;
  • Internet Protocol (IP) address.

2. How we use personal data

Datagator processes your personal data for the following purposes and on the basis of the following legal grounds:

Uncovering privacy violations

The Browser Extension analyses your Browsing Data to uncover privacy violations.  For your privacy, this processing takes place exclusively on your device.

  • Personal data category: Browsing Data
  • Purpose(s): to be able to determine whether you have been affected by a privacy violation, and store a record thereof on your device.
  • Legal basis: performance of the agreement you entered into when creating an account.

For your privacy, we minimize the amount of personal data the Browser Extension stores about websites you visited that (might) have privacy issues. We only store the domain names of the 10,000 most popular websites in your country. All other domain names are made anonymous (based on our legitimate interest to minimize stored personal data).

Providing privacy insights

Datagator empowers you to understand and take action on how your personal data is being used as you browse the web, for example which websites you visited have privacy issues, and which companies are tracking you.

For your privacy, this processing takes place exclusively on your device.

Collecting evidence

When you choose to participate in a case, the Browser Extension collects Evidence of relevant Browsing Data. For your privacy, this processing takes place exclusively on your device.

  • Legal basis: performance of the agreement you entered into when creating an account.

Anonymizing statistics

We collect anonymized statistics for identifying potential targets in cases. These statistics reflect the total number of individuals that have visited specific websites with privacy issues, and the total number of individuals that have been impacted by specific trackers.

  • Purpose(s): anonymize Browsing Data to create aggregated reports for the purpose of collecting statistics to identify potential targets in cases.

Bringing and handling cases

When you choose to participate in a case, you share Evidence with us which we require to be able to prove (in court) that you have been affected by a privacy violation.

  • Purpose(s): to be able to prove to third parties that you have been affected by a privacy violation.
  • Legal basis: performance of the agreement you enter into before you participate in a case

Communicating with you

  • Personal data category: Communication Data
  • Purpose(s): to (a) respond to your question, comment, request or complaint when you contact us, (b) to inform you of changes to the Terms of Use, (c) to inform you of changes to this privacy statement, and (d) to inform you.
  • Legal basis: Your consent (for example affirmative action by sending us an email), (b) performance of the agreement you entered into when creating an account, (c) our legal obligation to inform you about changes in our privacy statement, or in other cases, our legitimate interest to communicate with you.

Improving our Website

We monitor and analyse the usage of our Website using Matomo. All personal data collected for this purpose is anonymized and stored on our servers and not shared with any additional third parties.

  • Legal basis: our legitimate interest in being able to  improve our Website.

Providing our Browser Extension

  • Personal data category:  Extension Traffic Data
  • Purpose(s): to keep our Browser Extension operational and secure.
  • Legal basis: our legitimate interest in being able to continue providing our Browser Extension. This cannot be achieved if the Browser Extension is not available or does not function properly.

Providing our Website

  • Personal data category: Visitor Traffic Data
  • Purpose(s): to keep our Website  operational and secure.
  • Legal basis: our legitimate interest in being able to continue providing our Website. This cannot be achieved if the Website is not available or does not function properly.

3. Sharing

(Sub)processors

Datagator uses third-party service providers that process your personal data for the purposes mentioned above. These service providers are processors within the meaning of the GDPR, and may only process your personal data on instructions of Datagator and not for their own purposes. Datagator has concluded data processing agreements with these parties.

Third parties involved in cases

Datagator may share your personal data with other third parties in the context of (preparing and/or settling) a legal proceeding. For these purposes, Datagator may share personal data with lawyers, counterparties, litigation funders, experts, courts, bailiffs, and similar parties. To make payments, we will share your data with our bank. Where possible, we will always pseudonymize, aggregate, or anonymize the data.

(Social media) platforms

Datagator may run ads that don't use (profiles based on) tracking, or collaborate with influencers, on (social media) platforms.

For this use, Datagator is jointly responsible with the relevant platform. The processing by these platforms for which we are jointly responsible is limited to processing related to the display of our advertisements on the respective platform. For the processing of personal data for which we are jointly responsible, you can choose to exercise your rights by contacting either Datagator or the relevant platform.

Other third parties

Except for the third parties already mentioned, your personal data will only be shared outside Datagator if you have given consent beforehand, or if we need to do it to comply with our legal obligations.

4. Transfers to third countries

We, or third parties we engage, only process and store your personal data within the European Economic Area.

5. Retention

Datagator does not retain your personal data for longer than is necessary to achieve the purposes for which your data is processed. The following retention periods apply:

Browsing Data Until you delete the Browser Extension
Account Information Up to 7 days after you have terminated your account.
Evidence Up to 7 years after the case has been completed
Communication Data Up to one year after the message is sent or received
Visitor Traffic Data Indefinite – this data is anonymized before storage
Extension Traffic Data Never stored

6. Your rights

You have the right to request us to:

  • provide you with access to your personal data that we collect and process,
  • rectify or erase personal data,
  • restrict the processing of your personal data,
  • provide an electronic copy of your personal data for purposes of transmitting it to another company,
  • or to object to the processing.

You are also entitled to lodge a complaint with a data protection authority for your country or region or where an alleged infringement of applicable data protection law occurs. A list of data protection authorities is available at this link: here.

7. Security

We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of personal data. If you have reasons to believe that your data is not properly secured or if there are indications of abuse, please contact using the email address listed below.

8. Changes

We may update this privacy policy at any time. The “Last updated” note on this page indicates when it was last revised. Any changes will be effective from the time of publication of the new Privacy Policy. We encourage Users to regularly check this page for any changes to stay informed about how we are helping to protect the personal data we collect. We will notify Users by emails should any significant changes be made to this PrivacyPolicy.
